Is There a Time Limit to Resolve My Property Matter?

Understanding Property Settlement Timeframes Under Australian Family Law

When going through a separation or divorce, it’s natural to want space before dealing with legal and financial matters. However, it’s important to understand that time limits apply to resolving property settlements in Australia, and missing those deadlines can have serious consequences.

At South Coast Family Law Group, we often advise clients on when and how to act to protect their entitlements. Here’s what you need to know.

What Are the Time Limits for Property Settlements?

Under the Family Law Act 1975, strict time limits apply to when you can file an application for property settlement in the Federal Circuit and Family Court of Australia:

  • Married couples: You must apply within 12 months of your divorce being finalised.
  • De facto couples: You must apply within 2 years of the date of separation.

If you miss this window, you may need to seek the court’s permission to proceed, which is not guaranteed.

Why Do These Time Limits Matter?

These timeframes exist to ensure that financial matters between former partners are resolved promptly and fairly. Delaying action can lead to:

  • Loss of legal rights to claim a fair division of assets
  • Complications from changing asset values or new relationships
  • Increased financial and emotional stress over time
  • Difficulty gathering the necessary documents and evidence

The longer the delay, the harder it can be to reach a clean and equitable outcome.

What If I Miss the Deadline?

If you miss the deadline, you can still apply to the Court, but you must first obtain special leave (permission). The Court will only grant this in limited circumstances, such as:

  • If you can prove hardship
  • If there were exceptional reasons for the delay (e.g., illness, family violence)
  • If the claim has merit and is likely to succeed

However, applying out of time adds cost, uncertainty, and risk. It’s always better to act within the allowed timeframe.

When Should I Seek Legal Advice?

As early as possible. Even if you’re not ready to proceed immediately, it helps to understand your options and prepare for what’s ahead. The sooner you speak with a qualified family lawyer, the more time you have to gather financial information, explore negotiation options, and avoid the pressure of a looming deadline.
